MOVARIQ provides this website, including all information, content, features, tools, products and services available through it (the “Services”), in order to provide customers with an online shopping experience.
Our online store is powered by Shopify.
These Terms of Service (“Terms”), together with our Privacy Policy, Return and Refund Policy, Shipping Policy and any other policies referenced on our website, govern your access to and use of the Services and any purchases made through our store.
Please read these Terms carefully before using our website or placing an order.
By accessing or using the Services or purchasing a product from us, you agree to these Terms. If you do not agree to these Terms, you should not use the Services.
Nothing in these Terms affects your statutory rights as a consumer.

Receipt of an automated order confirmation does not necessarily mean that we have accepted your order.
A contract between you and us is formed when we accept your order and confirm that the order is being processed or dispatched.

If we cancel an order after payment has been taken, we will refund any amount paid for the cancelled products.

If you wish to cancel or amend an order, contact us as soon as possible. We cannot guarantee that an order can be changed or stopped after fulfilment has begun.
This does not affect any statutory cancellation or return rights available to you.

Prices displayed on our website are shown in the currency indicated at checkout.
The price charged will normally be the price displayed when your order is submitted.
Any applicable delivery charges or other mandatory charges will be displayed before you complete your purchase.
We reserve the right to correct obvious pricing errors.
If an obvious pricing error affects an order, we may contact you and offer you the option to purchase at the correct price or cancel the affected item for a full refund.
Payments may be processed by third-party payment providers including Shopify Payments and PayPal.
By submitting payment information, you confirm that you are authorised to use the relevant payment method.
You agree to provide accurate and current billing and payment information.
SECTION 5 – SHIPPING, FULFILMENT AND DELIVERY
We may use third-party suppliers, fulfilment centres, warehouses, logistics companies and delivery carriers to fulfil and deliver orders.
As a result, products may be dispatched directly from a third-party fulfilment location.
Estimated delivery periods displayed on our website are estimates rather than guaranteed delivery dates unless we expressly state otherwise.
We will take reasonable steps to deliver orders within the delivery period communicated to you and in accordance with applicable consumer law.
Delays may occasionally occur because of circumstances outside our reasonable control, including carrier disruption, customs processing, adverse weather, transport disruption or other exceptional events.
Risk of loss or damage to goods remains with us until the goods come into the physical possession of you or a person identified by you to receive them, except where applicable law provides otherwise.
If an order is delayed, lost or damaged in transit, please contact us rather than relying solely on the delivery carrier. We remain responsible for dealing with your order subject to applicable law.

SECTION 6 – CANCELLATIONS, RETURNS, REFUNDS AND FAULTY GOODS
Your rights regarding cancellations, returns and refunds are explained in our Return and Refund Policy, available through our website.
Nothing in these Terms or our Return and Refund Policy limits your statutory consumer rights.
Where applicable, consumers purchasing online may have a statutory right to change their mind and cancel an eligible purchase.
Different rules may apply to faulty, damaged, unsafe, incorrectly supplied or misdescribed products.
Where goods are faulty or do not conform to the contract, your statutory rights may include a refund, repair or replacement depending on the circumstances and applicable law.

We may occasionally offer discount codes, promotional pricing, bundles or other offers.

Unless otherwise stated, promotional codes cannot be exchanged for cash.

You must not reproduce, distribute, commercially exploit, scrape, republish or create derivative works from protected material on our website without appropriate permission.
Shopify and other third-party names, logos and trademarks remain the property of their respective owners.

We may make third-party tools, applications or integrations available through the Services.
These may include payment processors, delivery tracking services, reviews, analytics, social media functionality and other ecommerce services.
Your use of a third-party service may also be governed by that provider's own terms and privacy policies.
We are not responsible for third-party services to the extent that responsibility legally rests with the relevant third party.

SECTION 10 – RELATIONSHIP WITH SHOPIFY
MOVARIQ is powered by Shopify, which provides the ecommerce technology used to operate our online store.
However, purchases made through our store are contracts between you and COMERCECORE LTD trading as MOVARIQ.
Shopify is not the seller of MOVARIQ products.
To the extent permitted by applicable law, Shopify is not responsible for the products purchased from MOVARIQ or for disputes relating directly to the supply of those products by us.
SECTION 11 – PRIVACY AND PERSONAL INFORMATION
Our collection and processing of personal information is governed by our Privacy Policy, which is available through our website.
Our store is powered by Shopify, and certain information may also be processed by Shopify and other service providers involved in operating our store.

Any statutory rights you have in relation to significant delivery delays remain unaffected.
